Welcome to Pulsavo. These Terms of Service ("Terms") govern your access to and use of the Pulsavo website at https://pulsavo.com and the Pulsavo service ("Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

In these Terms, "we," "us," and "our" refer to Pulsavo. "You" refers to the individual or business entity accessing or using the Services.

What is Pulsavo? Pulsavo is a human-powered Google review reply service. A real person on our team monitors your Google Business Profile, learns your voice, and writes every reply by hand on your behalf.

Your responsibilities. You are responsible for the accuracy of the information you provide, for ensuring you have permission to connect your Google Business Profile, and for the content posted to your review profiles through the Services.

How replies are written. Every reply is written by a real person on our team in your voice. You remain responsible for content published to your review profiles.

Third-party platforms. Pulsavo connects to Google Business Profile to read reviews and post replies. Your use of that platform is governed by Google's own terms.

Termination. You can stop using the Services at any time. We may suspend or terminate access if these Terms are violated.

1. Description of Services

Pulsavo is a human-powered Google review reply service. A real person on our team monitors your Google Business Profile, learns your voice through onboarding, and writes every reply by hand on your behalf. We do not use AI, bots, or templates to generate replies.

The Services are designed for independent restaurants and small businesses that want thoughtful, on-brand responses to customer reviews without having to write each one themselves.

We may modify, update, or discontinue features of the Services at any time. We will make reasonable efforts to notify you of material changes that affect your use.

2. Eligibility and Account Registration

To use the Services, you must be at least 18 years of age. By using the Services, you represent and warrant that you meet this requirement.

If you are using the Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms, and you agree to these Terms on its behalf.

You agree to provide accurate, current, and complete information when registering for or using the Services, and to keep that information updated. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

3. User Responsibilities

When using the Services, you agree that you will:

• Only connect a Google Business Profile that you own or are authorized to manage on behalf of the account owner
• Comply with the terms, policies, and guidelines of any third-party platform you connect to the Services, including the Google API Services User Data Policy
• Provide accurate brand voice guidance, business information, and other inputs used to generate replies
• Review and take responsibility for content posted to your review profiles through the Services
• Comply with all applicable laws and regulations in your use of the Services

4. Human-Written Replies

Replies are written by a real person on our team based on the voice, guidance, and examples you provide during onboarding and over time. While we work to produce on-brand, appropriate, and high-quality responses, judgment calls are involved and individual replies may not be perfect for every situation.

You acknowledge and agree that:

• Replies may be posted to your review profiles on your behalf without per-reply approval unless you request otherwise (for example, for sensitive or negative reviews)
• You are ultimately responsible for content that appears on your review profiles, including replies written by our team
• We do not guarantee that every reply will be free of errors or perfectly aligned with your brand voice in every instance
• You are responsible for monitoring posted replies and providing feedback or adjustments as needed

5. Third-Party Platforms and Integrations

The Services connect to and rely on Google Business Profile to read reviews and post replies on your behalf. Your use of Google through the Services is also governed by Google's terms, policies, and privacy practices.

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

We are not responsible for the availability, accuracy, or content of any third-party platform. If a third-party platform changes its features, policies, or availability in a way that affects the Services, we will make reasonable efforts to adapt but cannot guarantee uninterrupted operation.

6. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights
• Post fraudulent, deceptive, misleading, or defamatory content
• Impersonate any person or entity, or misrepresent your affiliation with a business or brand
• Generate or post content that is harassing, hateful, discriminatory, sexually explicit, or otherwise inappropriate
• Manipulate review responses in a way that violates the policies of Google or other connected platforms
• Attempt to gain unauthorized access to the Services, other users' accounts, or our systems
• Interfere with or disrupt the integrity or performance of the Services
• Reverse engineer, decompile, or attempt to extract the source code or underlying components of the Services

We reserve the right to suspend or terminate access to the Services for any user who violates this section.

7. Intellectual Property

The Services, including the software, workflows, design, branding, and all related materials, are owned by Pulsavo and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works of the Services or any part of them without our prior written consent.

The Pulsavo name, logo, and other branding are our property. You may not use them without our permission, except to identify Pulsavo as the provider of the Services you use.

8. User Content

"User Content" means any content you provide to the Services, including business information, brand voice guidance, and sample replies used to guide the replies our team writes for your business.

You retain ownership of your User Content. By providing User Content to the Services, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content as necessary to provide the Services to you.

You represent and warrant that you have the rights necessary to provide your User Content to us and that your User Content does not violate the rights of any third party or any applicable law.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, error-free, secure, or that replies will be accurate, appropriate, or aligned with your business goals in every instance. We do not warrant that the Services will work without disruption when third-party platforms (such as Google) change their APIs, policies, or availability.

Pulsavo does not guarantee any specific business outcome, including but not limited to improved search ranking, customer retention, or revenue, from use of the Services.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will Pulsavo be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to these Terms or the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pulsavo and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of or access to the Services
• Your violation of these Terms
• Your violation of any third-party right, including the terms of Google or other connected platforms
• Your User Content or any content posted to your review profiles through the Services

12. Termination

You may stop using the Services at any time. If you have an account, you may close it by contacting us at thomas@pulsavo.com.

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Services.

Upon termination, your right to use the Services ends immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated date at the top of this page. If we make material changes, we will make reasonable efforts to notify you, such as by posting a notice on our website or sending you an email.

Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Services.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which Pulsavo is established, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or the Services will be resolved in the courts located in that jurisdiction, and you consent to the exclusive jurisdiction of those courts.
